Nicheliving: ‘Slum’ fears in Willetton as homeowners left furious over director Ronnie Michel-Elhaj’s new move

Premier Roger Cook has vowed Nicheliving won’t “lay a brick” as an audacious comeback launched by controversial director Ronnie Michel-Elhaj leaves Willetton homebuyers furious. Jason Nielson paid $630,000 for his build in 2021 but has been left surrounded by dirt due to unfinished works on common property that is not covered by home indemnity insurance. He’s pleading with the State Government to help foot the bill, after Nicheliving refused to. “We’re missing streetlights, footpaths, verges, and all kinds of miserable things in the common property,” he said. “We had a superficial inspection of what is visible from street level and got a 100-page defects report. “I met with Ronnie last October; he said that the syndicate that built the development had been dissolved and kicked me out of his office ... he gave me the runaround.” He was stunned to discover that Mr Michel-Elhaj and fellow director Paul Bitdorf had lodged a $2.7 million proposal to take Nicheliving Holdings and its subsidiary Projex Management and Construction out of voluntary administration. “I’m actually furious,” Mr Nielson said. “Absolutely frustrated, this is our forever home. We love our home, but we can’t drive on the roads; there’s no trees, and there’s no grass. “All the things that everyone has in a normal suburb, we do not have... We’re going to have to sell for a loss.” Mr Cook was surprised on Thursday when he was told that administrators from Kordamentha had supported Mr Michel-Elhaj’s and Mr Bitdorf’s bid ahead of a creditors’ vote next week. “It’s extraordinary, in fact, but I just want to reiterate that the ban concerning Nicheliving as builders remains in place,” he said. “They would not be able to build; they would not be able to lay a single brick.” He rejected claims the State Government’s deal not to pursue Nicheliving over home indemnity insurance claims let the pair off the hook. “I think the decision we made was a very decisive one and took action,” Mr Cook said. “Because of that action, those Nicheliving customers will be able to complete their homes sooner rather than later.” The West Australian can reveal that 83 claims have been processed for a total State Government payout of $15.9 million. The Government confirmed that home indemnity insurance only covers losses related to the building contract, not the developer responsible for common property infrastructure. Nationals Leader Shane Love said the Government should shoulder responsibility for failing to ensure the work was done before the title was transferred to the strata company. “There should be a trigger or a declaration and understanding that all outstanding works have been done,” he said. “I think the State Government does take some responsibility for that; it has not had checks and balances in place.” He said the area’s amenities are at risk, and the Government should step in to pay to clean it up. “Prices will fall, and the land values will fall, and the property will become something of an undesirable place or a slum,” he said. “The State Government has erred in not actually checking to ensure that these areas are being developed s required before transferring this to the owners.” In Willetton, the developer listed on City of Canning applications was Freedom Willetton Pty Ltd, which is partly owned by Nicheliving Projects. Mr Michel-Elhaj and Mr Bitdorf are both named as owners of the development application. “There’s no one to claim against because the builder is no longer registered,” Mr Nielson said. “And we said the claim is not against the builder. It’s against the developer, and nobody seems to want to care.”
